A 25-year-old man has been taken into custody on Wednesday following allegations of rape at Larry & Penny Thompson Park in Miami-Dade County, Florida, according to authorities.
Miami-Dade police have stated that Mario Gutierrez Tamayo and the victim, who is 30 years old, were familiar with each other and had arranged to meet at the park on the specified day.
Once they arrived at the scene, Gutierrez Tamayo requested that the victim undress.
The woman declined, stating that they were in a public park. At this point, Gutierrez Tamayo reportedly forcefully pulled her towards him by grabbing the back of her pants.
The report states that on September 24th, Gutierrez Tamayo’s cellphone was being searched by the police under a search warrant. During this process, Gutierrez Tamayo himself initiated a factory reset on the cellphone, an action that was witnessed by a Miami-Dade police lieutenant.
He turned himself in to the MDPD Special Victims Bureau/Sexual Crimes Investigations Unit on Wednesday, according to police, and was then taken to the Turner Guilford Knight Correctional Center.
Gutierrez Tamayo is currently in jail on a $10,000 bond as of Thursday afternoon.
